Terms of Service

1. Eligibility

You must be at least 13 years old or the minimum age of digital consent in your jurisdiction. If you are under 18, you confirm that a parent or guardian has reviewed and accepted these Terms on your behalf.

2. Accounts & Local Data

The Service currently stores favorites, history, and personalization settings locally in your browser. Do not share devices with people you do not trust. Future account features will be governed by additional terms.

3. Acceptable Use

• Do not upload, link to, or promote malware, hate speech, sexual content involving minors, or other prohibited material.
• Do not attempt to compromise platform security or interfere with other users’ enjoyment of the Service.
• Respect intellectual property rights. Only submit titles you own or are licensed to distribute.
• Follow individual game rules and respect community moderators.

4. Game Licensing & User Content

Developers retain ownership of their games. By submitting a title, you grant 99 Nights Game a non-exclusive, worldwide, royalty-free license to host, promote, and display the content for the duration of your participation.

We reserve the right to remove content that violates these Terms or third-party rights.

5. Advertising & Monetization

The Service runs Google AdSense and direct campaigns. Advertisers must comply with Google Publisher Policies and our internal advertising standards. We may display contextual or personalized ads depending on your consent preferences.

Developers participating in revenue-share programs will receive payout schedules and reporting terms separately.

6. Third-Party Links & Integrations

Some games are hosted on third-party platforms (e.g., Roblox, external HTML5 CDNs). Their terms, privacy policies, and age ratings apply in addition to ours. We are not responsible for external websites beyond reasonable due diligence.

7. Suspension & Termination

We may suspend or terminate access immediately if you violate these Terms, create security risks, or engage in fraud. You may stop using the Service at any time; retained data is handled per our Privacy Policy.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, 99 Nights Game will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

Some jurisdictions do not allow the exclusion of certain warranties or liabilities, so portions of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless 99 Nights Game, its affiliates, and employees from any claims or damages arising out of your use of the Service or violation of these Terms.

10. Changes to the Terms

We may update these Terms periodically. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles.
